These Terms of Service ("Terms") govern your use of the Neckly mobile application and the necklyapp website (together, the "Service"), operated by Dalkir Studio, an individual developer based in Türkiye ("we", "us", "our"). By creating an account, completing onboarding, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service. ## 1. What Neckly Is Neckly is a wellness app that offers guided neck-mobility, strength, posture and breathing exercises, a personalized "Neck Score", programs, challenges and educational content. Neckly is a general wellness tool. ## 2. Not Medical Advice Neckly does not provide medical diagnoses, treatment or professional healthcare advice, and it is not a substitute for care from a qualified physician, physiotherapist or other healthcare provider. Exercises, scores and recommendations are general in nature and are not tailored to any specific medical condition. If you experience persistent, severe or worsening pain, numbness, dizziness, or any symptom that concerns you, stop using the Service and consult a healthcare professional. You should consult a doctor before starting any new exercise routine, especially if you have a pre-existing neck, spine or cardiovascular condition, are pregnant, or are recovering from an injury or surgery. ## 3. Eligibility You must be at least 16 years old to create an account and use the Service. By using Neckly, you confirm that you meet this age requirement. If we learn that we have collected information from a user under 16, we will delete that account and the associated data. ## 4. Your Account Some features require an account (including anonymous, Apple or Google sign-in). You are responsible for keeping your credentials secure and for all activity under your account. Provide accurate information during onboarding — the personalization engine relies on it to build your daily program. ## 5. Subscriptions & Payments Neckly offers a free tier and an optional paid subscription ("Neckly Premium") that unlocks additional programs, challenges, the full Learn library and detailed Neck Score history. - Subscriptions are billed through the Apple App Store or Google Play, and processed via our subscription infrastructure provider (RevenueCat). We do not directly store your payment card details. - Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase (or the then-current price, where the store notifies you of a change in advance). - If a free trial is offered, any unused portion is forfeited when you purchase a subscription during the trial period. - You can manage or cancel your subscription at any time from your Apple ID or Google Play account settings. Cancelling stops future renewals; access continues until the end of the paid period. - Refunds are handled by Apple or Google according to their own policies — we cannot issue refunds directly. ## 6. Acceptable Use You agree not to: reverse-engineer or copy the Service beyond personal use; interfere with its normal operation; use it for any unlawful purpose; misuse another person's account; or attempt to extract exercise content, illustrations or program logic for redistribution or resale. ## 7. Intellectual Property The Service, including its exercise library, illustrations, the Nico mascot, Neck Score methodology and app design, is owned by Dalkir Studio and protected by copyright and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. ## 8. Disclaimer of Warranties The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose or that results (such as pain relief or score improvement) will be achieved. Individual results vary. ## 9. Limitation of Liability To the maximum extent permitted by law, Dalkir Studio is not liable for any indirect, incidental or consequential damages, or for any injury arising from performing exercises shown in the Service. You use the exercises at your own risk and should stop immediately if something causes pain. ## 10. Termination You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate accounts that violate these Terms. ## 11. Changes to These Terms We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use of the Service after a change constitutes acceptance of the revised Terms. ## 12. Governing Law These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the laws of your country of residence. ## 13.
